The following Terms and Conditions of Sale form part of our proposal unless otherwise agreed in writing prior to acceptance.
Quoted prices are based on specified quantities and volumes, as such; these prices are only valid for this order. Part acceptance or product changes to the current proposal may result in price variation.
All items will be manufactured specifically for you and as per the details outlined in your quotation. It is the responsibility of the customer to carefully check all information is correct. Colours and images are indicative only, refer to actual samples or documentation for true representation.
Please note your order is not confirmed, and no products or materials shall be ordered, until a deposit payment is received AND full product specifications are provided. Lead times will take effect from date of confirmed finishes. We cannot guarantee changes once a deposit has been paid.
While every reasonable effort will be made to achieve the lead times provided, Mint will not be held liable for any delays due to the unavailability of materials, late design approval, delayed deposit payments or any event beyond reasonable control.
PAYMENT TERMS:
- A non-refundable 50% deposit is to be paid on placement of order.
- This payment is treated as confirmation of the acceptance of the order and our terms and conditions.
- The full balance is payable prior to delivery.
- If lead time is less than 3 weeks OR if invoice is less than $5,000, the full invoice amount is to be paid at time of order.
- If delivery schedules are delayed by the customer for more than 2 weeks, we may request full payment or charge a storage fee based on a daily rate and the size of the storage space required.
A deposit payment is required and full product specification (including but not limited to; materials and finishes) is required for stock to be allocated and/or production to begin. Any delay in payment or specification will not be the responsibility of Mint FF&E to meet any pre-agreed timelines.
International freights & charges are included in the quotation. Domestic delivery from our warehouse in Alexandria to the venue is not included in the quotation unless otherwise stated. Where no freight is stated, the cost will be passed onto the client and invoiced with the balance prior to delivery of goods.
PLEASE NOTE THAT ORDER WILL NOT BE RELEASED UNTIL FULL PAYMENT IS RECEIVED.
SPECIFICATIONS & SAMPLES
Photographs, illustrations, and finishes provided by Mint FF&E are indicative only. Whilst reasonable efforts are made to supply goods without inconsistencies, Mint FF&E reserves the right to commercially match colours and/or substitute without notice.
Furniture samples provided by Mint FF&E are custom made and may vary from the final product.
Mint FF&E cannot be held responsible if the goods do not exactly match the image provided by the customer or image viewed on the web site due to the custom nature of manufacture.
Mint FF&E reserve the right to alter the specifications for future orders and cannot guarantee to match any previous orders.
WARRANTY
Unless otherwise specified, Mint FF&E Pty Ltd offers a standard 24-month manufacturer’s warranty on the supplied goods. This warranty begins from the receival of goods and is at the manufacturer’s sole discretion.
Products sourced from third parties may have limited or additional warranties and conditions that may need to be considered. Please consult Mint FF&E for itemised warranty details per product.
Should the goods prove to be defective within this warranty period, Mint FF&E will organise collection and inspect the goods and if the defect falls within our warranty inclusions Mint FF&E will at its discretion, replace or repair defective goods at our expense.
This warranty will only apply to goods being used for their designed purpose and only cover failures due to defects in materials or workmanship and will not cover normal wear and tear, damages or loss from accidents, misuse, abuse, neglect, mishandling, misuse, misapplication, alterations, or improper maintenance.
This warranty covers replacement of the same faulty item, and not a substitute item, unless agreed by both parties.
In the unlikely event of faulty goods and replacement required, every effort will be made to have this carried out quickly, however please allow reasonable manufacturing and delivery time.
PLEASE NOTE OUR WARRANTY DOES NOT COVER THE FOLLOWING;
- Furniture not used as per Mint FF&E’s recommendations. Products must be used in the location and use for which they were designed.
- Any damage arising from insufficient care, or from failure to comply with the supplied instructions and advice for receiving, assembling, using, and maintaining the furniture.
- Any changes in the visual appearance of wood that are directly linked to aging or exposure including air-conditioning. As wood is a living material, the appearance of its surface changes naturally over time.
- Normal fading due to light / sunlight.
- Scratching and chipping of paint or timber finishes.
- Stain, discolouring, corrosion, and damage caused by contact with chemicals, humidity, heat, organic materials such as bird droppings, sap, food, drinks, or leaves.
- Corrosion originating from scratches or abrasions that result from general wear and tear and which cannot be removed via standard cleaning and maintenance processes.
- Minor spots of rust under tabletops and seats or on bases. This is a natural outcome expected on products made of steel and can be treated using maintenance tools. This treatment should not be delayed, or rust will worsen.
- The corrosion of stainless-steel parts due to use in a confined, chlorinated environment.
- Corrosion of steel furniture (including but not limited to stainless steel furniture and fittings such as screws) as a result of use in a coastal environment, salt water and air exposure.
- General wear and tear.
DELIVERY & INSTALL
Delivery charges are based on the information provided by the customer and are subject to change or incur additional charges if there is any variation. Delivery charges are based on Monday – Friday between 9am – 5pm and do not include any placement, unpacking, removal of rubbish or other services unless otherwise specified. Furniture assembly and labour are included as standard.
Lead times are typically 12 – 14 weeks from receipt of deposit and product design confirmation, unless otherwise stated by Mint FF&E. Changes made to the order after deposit received can delay the lead time and delivery dates. Any delivery dates required should be advised at the time of order placement.
The lead time quoted is calculated in working days excluding global Public Holidays. Lead times will increase over the Christmas and Chinese New Year period. Please consult Mint FF&E to confirm lead times prior to order acceptance.
Mint FF&E cannot be held responsible for any delays in shipping from overseas ports, fumigation, Australian customs hold on containers for security and screening or quarantine restrictions, or other delays. Mint FF&E cannot be held responsible for these delays. Mint FF&E cannot be held responsible for any financial loss to clients due to the above delays.
If delivery is attempted by Mint FF&E or a third-party and the delivery site is not ready, suitable, safe or has the appropriate loading dock and lift access available and Mint FF&E are required to re-deliver the goods at a later stage, all costs and fees for the additional transport and storage costs will be charged to the customer prior to the next delivery.
Mint FF&E reserves the right to deliver the goods in whole or in instalments and in such event, the customer must not refuse to take delivery of the goods.
Where a shipping container is requested to be dropped on Council property or road, Council approval will need to be obtained by the customer before delivery can take place.
Mint FF&E reserves the right to charge the Customer storage on goods if the scheduled delivery date is extended by the customer.
Goods remain the property of Mint FF&E until final payment is received. Mint FF&E will not dispatch any order unless full payment has been received or other terms have been agreed to in writing.
CLIENT STORAGE
The customer can organise storage prior to installation at their own discretion however the customer must inspect the goods on delivery and prior to storage and notify Mint of any issues. Please note, Mint will not take responsibility for any damage or issues found after the furniture items have been removed from storage.
If placement of furniture is required after storage, the customer will incur additional costs.
CUSTOMER DISCLAIMER
By agreeing to the quotation issued by Mint FF&E Pty Ltd the customer hereby disclaims the right to rescind or cancel the contract or to sue for damages or to claim restitution arising out of any misrepresentation made to him/her by any servant or agent of the seller and the customer acknowledges that he/she buys the goods relying solely upon his own skill and judgement and that the seller shall not be bound by nor responsible for any term, condition, representation, or warranty other than the warranty given by the manufacturer which shall be personal to the customer and shall not be transferable to any subsequent customer.
The customer shall inspect the goods on delivery and shall within 7 days of delivery notify the seller of any alleged defect , shortage in quantity , damage or failure to comply with the description or quote. The client shall afford the seller an opportunity to inspect the goods within a reasonable time following delivery.
ERRORS AND OMISSIONS
The Customer acknowledges and accepts that Mint FF&E shall accept no liability in respect of any alleged or actual error(s) and/or omission(s):
(a) resulting from an inadvertent mistake made by Mint FF&E in the formation and/or administration of the Contract; and/or
(b) contained in/omitted from any literature (hard copy and/or electronic) supplied by Mint FF&E in respect of the Services.
The Customer is responsible for supplying correct order information such as, without limitation, measurements, and quantity, when placing an order for Goods (whether they are made to order Goods or not)
FORCE MAJEURE
Mint FF&E Pty Ltd shall not be liable for any direct, indirect special or consequential loss or damage of any kind arising from non-delivery or delay in delivery of any goods or services caused by an act of God, riot or civil commotion, strike, lock out, labour disputes, fire, flood, drought, power restrictions, act of government, acts of terrorism, delays in transport, breakdowns in machinery, failure to obtain or shortages of raw materials or other supplies obtained from third parties or any cause whatsoever beyond its control.
CANCELLATIONS
Any order that is accepted by Mint FF&E Pty Ltd that is being custom manufactured is unable to be cancelled. Any orders cancelled by the customer will result in a loss of the full deposit.
Manufacturing delays outside the control of Mint FF&E will not entitle the customer to cancel the order or seek compensation.
RETURNS & REFUNDS
Mint FF&E does not accept returns for change of mind or orders made in error. Deposits and payments in full will not be refunded.
The customer must report of any defected product within 7 days. The customer shall inspect the goods on delivery and shall within 7 days of delivery notify Mint FF&E of any alleged defect, shortage in quantity, damage, or failure to comply with the invoice, furniture schedule or on the approved contract.
Mint FF&E will conduct an assessment to inspect the goods or investigate the claim. If inspection concludes that it falls within the warranty inclusions, we will either fix or replace the goods. Mint FF&E reserves the right to correct any goods delivered that do not meet specifications and requirements.
